Global aviation safety concerns motivate new ICAO legal guidance to improve compliance

Global aviation safety concerns motivate new ICAO legal guidance to improve compliance

New tools on the Rules of the Air to improve aviation safety

The “Rules of the Air” established by the Convention of International Civil Aviation govern how all international flights operate, from takeoff to landing, to ensure safe and predictable aviation worldwide. Article 12 of the Convention requires every country to enforce these rules for aircraft in its territory and its own aircraft wherever they operate and to keep its rules aligned with the standards set by ICAO to the greatest extent possible. Each country must also prosecute violations. But recent reviews show enforcement is inconsistent, and coordination is often lacking, creating challenges for accountability and undermining global aviation safety.

Countries use a mixture of approaches to enforce compliance, ranging from prosecuting violations as crimes, issuing fines, or requiring retraining. The result is that a pilot or operator may face different consequences depending on where an incident occurs. These differences alone can create uncertainty about whether the obligations of Article 12 are being met.

Many authorities also struggle to coordinate. A legal survey found 75% of the responding countries lack systems to share information on violations involving foreign aircraft. Notifications are sometimes delayed or lost, especially for events on flights over the high seas, where jurisdiction is unclear. These gaps in notification, enforcement and cooperation continue to limit effective oversight. Privacy concerns and legal risks also discourage open data-sharing, making it harder to foster the culture of safety reporting that ICAO encourages. These gaps in notification, enforcement, and cooperation continue to limit effective oversight.

In response, the ICAO Legal Committee has proposed several major solutions today.

The first is a comprehensive guidance document, the first one of its kind, on implementing Article 12. The second is a new ICAO communication platform that will serve as a point of contact for notifying potential violations between countries. The platform aims to formalize communication, speed up exchanges, and ensure responsible officials are clearly identified and reachable.

The Committee also stressed flexibility in enforcement, clarifying that countries should be able to meet their Article 12 commitments through a range of methods: administrative penalties, civil actions, or educational measures, not only criminal prosecution. Uniformity, in other words, is achieved through effective safety outcomes rather than a one-size-fits-all approach.

Lastly, the Committee pointed to existing regional arrangements as promising templates for broader cooperation and mutual assistance.

The recommendations will now go to the ICAO Council for review.
