The Executive Committee considered Agenda Items 16.1, 16.2, 16 and 19.
Under Agenda Item 16.1 The Committee completed consideration of the development of an up-to-date consolidated statement of continuing ICAO policies related to the safeguarding of international civil aviation against acts of unlawful interference, documented in WP/4 and in WP/106, presented by Airports Council International (ACI).
UnderAgenda Item 16.2 The Committee also completed its review, of the Mechanism for financial, technical and material assistance to States with regard to aviation security, which it had considered on the basis of WP/5, WPs/131 and /132 presented by the Islamic Republic of Iran and WP/106 presented by ACI.
Under Agenda Item 16 Tthe Committee had for consideration WPs/131, /132 and /164 presented by the Islamic Republic of Iran, WP/67 presented by the United States and information paper WP/85 Revised presented by 37 Contracting States, Members of the European Civil Aviation Conference (ECAC) on aviation security-related matters. With respect to WP/67, it was agreed that the Secretariat would prepare a draft Resolution on the basis of the one presented in Appendix A to the working paper and comments made during the discussion and would submit it for consideration in conjunction with the draft Report material on this item.
Under Agenda Item 19 The Committee reviewed WP/45 setting forth an overview of technical and operational activities related to CNS/ATM systems and WP/48 on the economic aspects of the implementation of CNS/ATM systems. It also reviewed WP/144 presented by the 37 Contracting States, Members of ECAC, and information paper WP/129 Revised, presented by the European Community, the European Organization for the Safety of Air Navigation (EUROCONTROL) and the European Space Agency, which it referred to the Legal Commission.
The Committee considered WP/59 which presented a report by the Council on the results of the World-wide CNS/ATM Systems Implementation Conference and the Council's subsequent actions thereon. The Committee invited the Assembly to note the report and to approve the draft resolution related to follow-up to the 1998 World-wide CNS/ATM Systems Implementation Conference set out in the appendix to the working paper.
The Executive Committee noted WP/143 presented by the International Business Aviation Council (IBAC) on the subject of airspace access for aircraft operating agencies and referred the working paper to the Council for further action as deemed necessary.
WP/34, which presented a proposal for promoting enhanced support to ICAO positions developed for ITU World Radiocommunication Conferences (WRCs), was reviewed by the Executive Commission in conjunction with WP/113 and WP/123 presented by the United States and the European Organisation for the Safety of Air Navigation (EUROCONTROL) respectively. With respect to WP/34, the Committee invited the Assembly to adopt the draft resolution, with some minor amendments.
The Executive Committee reviewed WP/138 presented by the Islamic Republic of Iran which made a certain number of proposals in the area of air traffic management (ATM). The Committee also referred WP/133 presented by the Islamic Republic of Iran to the Legal Commission.
WP/107 on the subject of the benefits of CNS/ATM systems to airport operators presented by Airports Council International (ACI) was reviewed by the Executive Committee and the Assembly was invited to take note of the contents of the working paper.
WPs/150, 42, 130, 153, 139, 56, 99, 163 and 155 were for information and therefore were not discussed by the Executive Committee.
The Executive Committee started consideration of Agenda Item 17 with the main paper, WP/61. The Committee invited the Assembly to: note the progress report on the implementation of the ICAO safety oversight programme; note the recommendations made by the DGCA Conference on a Global Strategy for Safety Oversight; endorse the establishment of an ICAO universal safety oversight programme; and to adopt accordingly the draft Assembly resolution, as amended by the Executive Committee.
WP/91 (presented by Bolivia, Canada, Mexico and the United States), which proposed specific implementing measures with respect to the transparency and increased disclosure of summaries of the final reports and the frequency of assessments, was reviewed by the Executive Committee.
WP/134 presented by the Islamic Republic of Iran with respect to the ratification of Article 83 bis of the Convention on International Civil Aviation was referred to the Secretariat.
The Executive Committee considered WP/92 related to the expansion of the safety oversight programme presented by the United States and Canada. The Committee requested the Assembly to: urge the Secretariat to develop criteria, including SARPs, on requiring regulatory oversight of air traffic services, aerodromes and support facilities as soon as possible as the first step in expanding the safety oversight programme; recommend to the Council that the safety oversight programme be expanded, at the appropriate time, to air traffic services, aerodromes and support facilities and services at such time as the criteria for expansion put forth at the 1997 DGCA meeting are met; and consider the feasibility of regular and mandatory audits of aviation security, initiating action to study carefully and evaluate the impact on resources as well as other elements.
WP/158 presented by the African Contracting States on safety oversight was reviewed by the Executive Committee and the action suggested in the working paper, as amended by the discussion, was noted.
At the request of the United States, WP/31 on the subject of improving assistance to victims and their families involved in civil aviation accidents (Agenda Item 18) was introduced to the Executive Committee.
The Administrative Commission considered the following items on the agenda: Item 38.1 - Financial aspects of the question of contributions in arrears, and Item 38.3 - Incentive scheme for settlement of long outstanding arrears, both in WP/47 EX/16, AD/11, Revision No. 1 and Addendum No. 1. Item 38.4 - Report on the Working Capital Fund (WP/37, AD/6). Item 38.5 - Distribution of cash surplus (WP/38, AD/7). Item 38.6 - Amendment of the Financial Regulations (WP/62, AD/12, Addendum/Corrigendum No. 1, Corrigendum No. 2 DOC 7515/9). Item 39 - Review of expenditures, approval of accounts and examination of Audit Reports for the financial years 1995, 1996 and 1997 (WP/17, AD/2 & Doc 9697; WP/18, AD/3 & Doc 9698; WP/33, AD/4 & Doc 9714). Item 40 - Assembly resolutions to be consolidated or to be declared no longer in force (WP/27, P/9 (Appendix D), and Doc 9662).
The Budget Working Group considered the Programme Budget estimates These are contained in WP/46, AD/10, Addendum No. 1 & Corrigendum No. 1, and Addendum No. 2.
The Legal Commission considered Agenda Item 35 and 34
This included WP/10, WP/20 Revised and WP/134 concerning the subject of Slow Progress of Ratification of International Air Law Instruments, including Amendments to the Convention on International Civil Aviation .
Under Agenda Item 34
This deals with the work programme of the Organization in the legal field. The Commission considered WP/72 Revised and WP/167 concerning unruly passengers; WP/71 Revised concerning the Unidroit Draft Convention on International Interests in Mobile Equipment and the related Protocol on Aircraft Equipment; and WP/24, WP/129 and WP/133 concerning the establishment of a legal framework with regard to GNSS.
The Legal Commission completed consideration of all issues assigned to it, including the review of priority of the items listed in the General Work Programme of the Legal Committee, on the basis of WP/25.
The Economic Commission considered Agenda items 7, 8 and 30
Under Agenda item 7 The Commission undertook and completed a review of Chapters I, III, IV and the air transport sections of Chapter VII of the Annual Reports of the Council for 1995, 1996 and 1997.
Under Agernda Item 8 The Commission completed its examination of the Work Programme in the Air Transport field of the Organization for 1999-2001 in the Programme Budget, WP/46 and Addendum No. 1, Corrigendum No. 1 (E) and Addendum No. 2.
Under Agedna Item 30 The Commission reviewed The World of Civil Aviation for the years 1995 and 1996, Circular 270 on the Outlook for Air Transport to the Year 2005, and considered WP/105 on the Update of Medium and Long Term Traffic Forecasts, and WP/111 presented by ACI. The Commission also reviewed to working papers: WP/89 presented by Canada containing a resolution which the Commission agreed to present with suggested amendments for adoption by the Assembly; and WP/115 presented by ACI.
